  • Columbus Drywall & Insulation, Inc., et al. v. MASCO Corporation, et al., United States District Court for the Northern District of Georgia

    • The firm serves as a Lead Counsel in this antitrust class action.

    • We successfully defeated several motions to dismiss.

    • We obtained class certification on behalf of our clients and similarly situated purchasers.

    • The firm engaged in significant merits and expert witness discovery and successfully defended multiple Daubert challenges to economic experts’ testimony

    • We defeated a motion for summary judgment.

    • We obtained settlements in the amount of $37.25 million from all but one defendant. Settlement proceeds have been distributed to our clients and other residential fiberglass insulation contractors.

    • We continue to prepare for trial against the remaining defendant.

  • In re Motorsports Merchandise Antitrust Litig., United States District Court for the Northern District of Georgia

    • The firm served as a Lead Counsel in this antitrust class action alleging price fixing of race-related merchandise sold at motor sports events.

    • We settled this litigation prior to class certification and obtained a full refund of our clients’ and class members’ purchases, in addition to other substantial relief, for a total settlement of more than $11 million.

  • In re Nylon Carpet Antitrust Litig., and In re Polypropylene Carpet Antitrust Litig., United States District Court for the Northern District of Georgia

    • The firm served as a Lead Counsel in these antitrust class actions, in which we represented several small businesses against the major carpet manufacturers in the United States.

    • We successfully defeated motions to dismiss.

    • We obtained class certification on behalf of our clients and similarly situated purchasers.

    • Our team engaged in significant merits and expert discovery and in a Daubert evidentiary hearing on economic experts utilized by the parties.

    • We defeated motions for summary judgment.

    • The firm settled these matters on the eve of trial for approximately $50 million.

  • In re Vitamins Antitrust Litig., United States District Court for the District of Columbia

    • The firm served on the Steering Committee in this massive antitrust class action involving an international cartel in the vitamins industry.

    • We represented several business clients in this matter.

    • Our team assisted in obtaining a universal settlement of over $1.1 billion.

  • Thomas & Thomas Rodmakers, Inc., et al. v. Newport Adhesives & Composites, Inc., United States District Court for the Central District of California

    • The firm represented business clients in this nationwide class action against the world’s leading manufacturers of carbon fiber.

    • Certain defendants ultimately settled the litigation for $32.75 million.

  • In re MSG Antitrust Litigation, United States District Court for Minnesota

    • The firm served on the discovery committee in this case alleging an international cartel brought on behalf of direct purchasers of MSG and other food flavor enhancers.

    • Working with co-counsel, the firm obtained a recovery of more than $123 million from suppliers in the United States, Japan and Korea.

  • In re Linerboard Antitrust Litigation, United States District Court for the Eastern District of Pennsylvania

    • The firm represented business clients in this horizontal price-fixing case against the major manufacturers of corrugated and sheet linerboard.

    • This litigation ultimately settled for approximately $202 million.

  • In re Commercial Tissue Antitrust Litigation, United States District Court for the Northern District of Florida

    • Chitwood Harley Harnes represented plaintiffs in this horizontal price-fixing action against major manufacturers of commercial tissue.

    • This matter settled for $54 million in cash and purchase certificates.
